These Terms of Service ("Terms") govern your access to and use of fal-digital.com and the FAL Digital services, including interactive e-books, audio features, and educational games (the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Eligibility and children

The Service is intended for parents/guardians, teachers, and families, and may be used by children with the involvement and consent of a parent/guardian.

If you are a parent/guardian, you are responsible for supervising a child's use and ensuring the child's use complies with these Terms.

If you do not have legal authority to consent to these Terms, you must not use the Service.

3) Accounts and sign-in

You may need an account to access parts of the Service (for example, to unlock e-books or games).

If you use Google Sign-In, you agree to comply with Google's terms as well.

You must provide accurate information and keep your account secure.

4) Service availability and access levels

The Service is an evolving digital learning platform. It may experience planned or unplanned downtime, and features or content may change as we improve the Service.

We offer different access modes:

• Preview access (limited content available before purchase)
• Approved or school-managed access (expanded content for approved users)
• Paid subscriptions (access to premium content via subscription plans)

We may change, suspend, or discontinue any part of the Service at any time, including access rules, features, and content, to improve the Service, ensure security, or comply with law.

5) Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or educational use.

You must not:

• copy, reproduce, distribute, sell, rent, lease, or publicly perform the content unless we explicitly allow it;
• remove watermarks, copyright notices, or branding;
• bypass access controls or attempt to access locked content without permission.

6) Intellectual property

The Service, including the website, design, code, games, audio features, and all educational content made available through the Service, is owned by or licensed to FAL Digital and is protected by intellectual property laws.

You do not acquire any ownership rights by using the Service.

7) User content (if you submit anything)

If the Service allows you to submit content (e.g., feedback, messages, support requests, or suggestions):

• you grant us a worldwide, royalty-free licence to use it for operating, improving, and supporting the Service;
• you confirm you have the rights needed to submit it;
• you must not submit unlawful, harmful, or infringing content.

8) Acceptable use and prohibited activities

You agree not to:

• use the Service for illegal activities;
• attempt to hack, disrupt, or reverse engineer the Service;
• scrape or harvest data from the Service without permission;
• upload malware or abuse the platform;
• impersonate others or misrepresent affiliation;
• violate the rights of others (including IP rights).

We may suspend or terminate access if we believe you have violated these Terms.

9) Payments and subscriptions

Subscription Plans: We offer paid subscription plans that provide access to premium content for selected books and features. Subscriptions are processed through our third-party payment provider.

9.1) Payment provider

Payments are processed by a third-party payment processor on our behalf. By purchasing a subscription, you also agree to that processor's applicable terms and privacy policy. The payment processor handles payment processing, fraud prevention, and tax collection where applicable.

9.2) Subscription plans and pricing

We offer subscription plans with different billing cycles (monthly, 3-month, 6-month, 9-month). Pricing is displayed before you subscribe. Prices are in the currency shown and may vary by location. Applicable taxes may be collected by the payment processor where it acts as merchant of record.

We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions immediately. For existing subscriptions, we will provide at least 30 days' notice before price increases take effect.

9.3) Billing and auto-renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorise us (through our payment processor) to charge the payment method you provide at the time of purchase for each renewal period.

You are responsible for keeping your payment information up to date. If payment fails, we may suspend or cancel your subscription. You will be notified of payment failures via email.

9.4) Cancellation and refunds

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period. You will continue to have access until the period ends.

Refund Policy:

• 14-day money-back guarantee: If you cancel within 14 days of your initial purchase, you are entitled to a full refund, regardless of usage, in accordance with UK Consumer Contracts Regulations and similar laws in other jurisdictions.
• After 14 days: Refunds for cancellations after the 14-day period are not automatically available but may be considered on a case-by-case basis for technical issues, billing errors, or exceptional circumstances. Contact us at [email protected].
• Partial refunds: We do not provide partial refunds for unused portions of subscription periods unless required by law.

Processing refunds: Refunds are processed through our payment processor and will be credited to your original payment method within 5-10 business days, depending on your payment provider.

9.5) Subscription changes and upgrades

You may upgrade or change your subscription plan at any time. Changes take effect immediately. If you upgrade mid-cycle, you may be charged a prorated amount. Downgrades take effect at the start of your next billing cycle.

9.6) Access upon subscription

Access to premium content is granted automatically upon successful payment. If you do not receive access within a reasonable time (typically within minutes), please contact us at [email protected] with your order details.

9.7) Subscription termination by us

We may suspend or terminate your subscription if:

• you violate these Terms,
• payment fails and is not resolved after notice,
• we discontinue the subscription service (in which case you will be refunded for the unused portion),
• required by law.

10) Third-party services and links

The Service relies on third-party services including:

• Payment processing: Third-party payment processor (payment processing, fraud prevention, tax collection where applicable)
• Hosting and infrastructure: Cloudflare (CDN, security), Supabase (database, authentication)
• Authentication: Google Sign-In (optional, if you choose to use it)
• Other services: Analytics, error monitoring, and similar operational services

We are not responsible for third-party services or sites, and your use of them may be governed by their own terms. We encourage you to review their terms and privacy policies.

11) Privacy

Our collection and use of personal data is explained in our Privacy Policy. By using the Service, you agree that we can process information as described there.

12) Disclaimer

The Service is provided on an "as is" and "as available" basis.

We do not guarantee that:

• the Service will be uninterrupted, error-free, or always available;
• content will be accurate or suitable for every learner;
• any specific educational outcomes will be achieved.

Nothing in these Terms limits rights you may have under applicable consumer protection laws.

13) Limitation of liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption.
• Our total liability for any claim relating to the Service will not exceed the amount you paid us in the last 12 months (or £100, whichever is higher). For free users, our total liability is limited to £100.
• We do not guarantee uninterrupted access or that all features will work as expected at all times.

This does not limit liability where it cannot be excluded by law (for example, for death or personal injury caused by negligence, or fraud). Nothing in these Terms affects your statutory rights as a consumer.

14) Indemnity

If you use the Service in breach of these Terms or the law, you agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse.

15) Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• you violate these Terms,
• we need to protect the Service or other users,
• required by law,
• or we discontinue the Service.

16) Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows the latest version. If changes are significant, we may post a notice on the site.

By continuing to use the Service after updates, you agree to the updated Terms.

17) Governing law and disputes

These Terms are governed by the laws of England and Wales.
